Definition of No-Fault Separation and Its Leeway

Divorce is the official termination of a marriage. The divorce ceases all legal contracts and bonds of nuptial between two married people. Many nations consent to this kind of divorce. There are currently several classifications for divorce and one of them is the “No fault” divorce.

In the no-fault divorce, no party is required to prove anything negative to the other. The divorce is commenced upon the application from any family court. The petition can be initiated by either party.

In the no-fault divorce, a spouse should use a legally suitable reason for the dissolution of marriage. The most frequently-used reasons are “irreconcilable differences” and “incompatibility”. These are much lighter compared to the basis for at-fault divorce which are infidelity, domestic violence, and abandonment among others.

In some states, the couple must have lived separately for several months or even years prior to the filing of a no-fault divorce.

The no-fault divorce was first practiced in Russia, particularly by the Bolsheviks, during the early 20th century. In Canada, the no-fault divorce has taken effect after the revision of the Divorce Act in 1986, which requires that each spouse must have lived separate from each other for at least one year. In the United States of America, the state of California was first to apply the no-fault divorce in 1970. Currently, no-fault divorce is being practiced by almost all of the states of USA.

Why was the no-fault law strived for by a number of legislators? In the USA, prior to the signing of Family Law Act of 1969, reasons for divorce were much heavier and more difficult to prove, which oftentimes resulted for spouses to twist facts and destroy each other’s integrity. The lawyers and judges got dead beat of this scenario, hence they strived to have a better law that can somehow protect the image of family court systems.

To date, the no-fault divorce absolutely minimizes the clash and emotional anxiety for both parties. It’s also now much effortless to get out of a marriage that is filled with any kind of abuse. And because the proceedings became easy, the no-fault divorce law has greatly helped in lessening the case loads of family courts.
